Quick answer

Can a deed poll be backdated?

No. A deed poll has to carry the date you actually sign it. An earlier date makes it a false document, and HM Passport Office checks that a deed poll was made at the time. The good news is you rarely need to: your new name works from the day you sign, and there are proper routes for a name you’ve used for years.

The quick answer

Never backdate a deed poll. Date it the day you sign it in front of your witnesses. The Forgery and Counterfeiting Act 1981 treats a document as false if it claims to have been made on a date when it wasn’t, and HM Passport Office only accepts a deed poll that was made at the time.

You almost never need to. If you’ve used a name for years, a deed poll signed today makes it official from today, and your payslips and bank statements already show the history. If you have to prove an older change, a statutory declaration is the document that covers the past.

Why a deed poll can’t be backdated

A deed poll says that from its date you give up your old name and use your new one. An earlier date would claim something that didn’t happen that day. The Forgery and Counterfeiting Act 1981 says a document is false if it purports to have been made on a date when it wasn’t, so a backdated deed poll is a false document. Forgery and Counterfeiting Act 1981, section 9

It also fails the checks. HM Passport Office’s caseworkers accept an unenrolled deed poll when it’s dated and is a contemporaneous document, meaning it was made when it says it was, and they ask for a new one if they have doubts about how genuine it is. Signing a little after your deed poll arrives is fine. Just make sure it shows the date you actually sign it, with your witnesses watching.

Used your new name for years without a deed poll?

Your name is already yours. Cornwall Council’s registration service explains that under English common law you can take a new surname without any formal record, and the name changes through use. What a deed poll adds is the proof organisations ask for. Cornwall Council: changing your name

So sign one now, dated today. It names your old name and your new one, and it works from the day you sign it. Pair it with something that shows you’ve used the name, such as a recent bank statement or payslip, and most organisations will update you. Our guide to changing your name years ago without a deed poll goes through it.

Will today’s date cause problems with my records?

Not usually. Organisations update your name from when you tell them, so your passport, driving licence and bank cards show your new name from their next issue, and old payslips and statements stay in your old name. That’s normal, and your deed poll is the link between the two.

Already booked travel? The name on the ticket has to match your passport, whatever date your deed poll shows. See booking a flight before your new passport arrives.

Want your records to catch up quickly? Add extra copies to your order so the Passport Office, the DVLA and your bank can each have one at the same time. See how many copies you need.

Yes. There’s no rush to sign. Just make sure it shows the date you actually sign it, with both witnesses watching.

Your deed poll takes effect from the day you sign it. The years you’ve used the name are shown by your other records, such as payslips and bank statements, and organisations look at both.

Yes. HM Passport Office says a statutory declaration should cover every name you’ve used, when you used each one and why it changed. That’s why it’s used for old changes with gaps in the paperwork.

No. A passport shows your name, not the date it changed. HM Passport Office looks at the date on your deed poll when it checks your evidence.

Don’t use it. Sign a new deed poll, dated the day you sign it, in front of two witnesses, and use that instead.
