Weddings abroad

Changing your name after marrying abroad

A wedding abroad is legal in the UK if it was legal where it happened, so your foreign marriage certificate can work for your new name. But a celebration certificate from a tour operator won’t, a certificate in another language needs translating, and some don’t show your names clearly. That’s where a deed poll comes in.

The quick answer

If your marriage was legal in the country where it took place, and would be allowed under UK law, the UK recognises it. HM Passport Office accepts a foreign marriage certificate as evidence of your new surname if it shows the link between your old and new names. You can’t register the marriage again in the UK, so the foreign certificate is the one you’ll use.

If your certificate isn’t in English or Welsh, the Passport Office wants a certified translation, and a celebration certificate from a tour operator won’t be accepted at all. A UK deed poll gives you one clear document in English for every organisation, for £14.95 with free tracked delivery.

Is a marriage abroad recognised in the UK?

GOV.UK says a marriage or civil partnership abroad is recognised in the UK if it was lawful in the country where it took place and would be allowed under UK law. The local authorities register it, and you get your certificate through the person who conducted the ceremony. A ceremony at a British embassy, high commission or consulate is the exception: it’s registered in UK records and you get a UK certificate. GOV.UK: register your marriage or civil partnership abroad

Otherwise, GOV.UK says you can’t get a UK marriage certificate for a marriage abroad, so the foreign certificate is the proof you’ll use. Councils such as Wandsworth suggest getting extra certificates, and translations if you need them, while you’re still there. Wandsworth Council: getting married abroad

What the Passport Office accepts

HM Passport Office’s guidance accepts a marriage certificate as evidence of a change of name if it shows the link between your old and new names, and its staff check that the certificate is acceptable and legal in the country that issued it. HM Passport Office: evidence to change a name

It won’t accept a marriage celebration certificate from a tour operator. Its guidance says you must register the marriage with the relevant authorities to get an official certificate, and that checking your marriage is legally recognised is your responsibility.

If a document isn’t in English or Welsh, GOV.UK says to send a certified translation with it, and to send originals, not photocopies. GOV.UK: documents for a passport application

When a deed poll is the easier route

  • Your certificate isn’t in English. You’d need a certified translation for the Passport Office, and other organisations may ask for one too. A deed poll is already in English.
  • Your certificate doesn’t show both names clearly. The Passport Office needs to see the link between your old and new names. A deed poll states both in full.
  • You only had a celebration certificate. If the ceremony wasn’t a legal marriage, you aren’t married in law, so you’d take your partner’s surname with a deed poll, just like a couple who haven’t married.
  • You want more than a straight surname swap. A blended surname, your maiden name as a middle name or a new first name needs a deed poll wherever you married.
